Terms of sale

Preamble

These terms and conditions are concluded between:

MHBW SAS, registered with the Paris Trade and Companies Register under number 89290618100011, with its registered office at 34, avenue des Champs Élysées, 75008 Paris, France, VAT number FR20892906181, operating the website Parfumfrance.com (hereinafter referred to as “Parfumfrance.com” or “the Seller”),

and any person wishing to make a purchase via the website Parfumfrance.com (hereinafter referred to as “the User” or “the Customer”).

The parties agree that their relationship shall be governed exclusively by these Terms and Conditions of Sale (TCS) in effect on the date of the order. In the absence of a specific provision, industry practices in the field of distance selling in France shall apply. MHBW SAS undertakes to comply with all provisions of the French Consumer Code relating to distance selling.

Purpose

These Terms and Conditions define the rules governing sales between the Seller and the Customer, from order placement through payment, delivery, and after-sales service.

Orders

  • Customers may place orders online via the store.

  • Any order implies acceptance of the prices and descriptions of the products available for sale.

  • Customers may modify their basket before final validation. The final validation constitutes acceptance of the contract.

  • Orders are fulfilled subject to product availability. In case of unavailability, Parfumfrance.com will inform the Customer.

  • In the event of non-payment, incorrect address, or other issues with the Customer’s account, the Seller reserves the right to block the order until the issue is resolved.

  • For order tracking inquiries, Customers may use the contact form available on the website.

Delivery

  • Shipping terms and costs are detailed in the Shipping Policy.

  • Standard delivery times are estimated at 8 to 15 business days.

  • Delivery may be made to the Customer’s home or to another address specified at checkout.

Payment Terms

Customers may pay for their purchases using the following methods:

  • Paypal

  • Klarna

Prices

  • Prices displayed on the site are in euros, inclusive of VAT, but exclusive of processing and shipping fees.

  • Prices reflect the VAT rate in effect at the time of the order. Any change in the rate may affect product prices.

  • Once confirmed, the price of an order cannot be modified.

  • Additional customs duties, import taxes, or fees may apply for orders outside the European Union and French overseas territories. These costs are the responsibility of the buyer.

Legal Warranties

In accordance with French law:

  • Article L211-4 of the Consumer Code: The Seller must deliver goods in conformity with the contract and is liable for any non-conformity existing at the time of delivery.

  • Article L211-5 of the Consumer Code: Goods must correspond to their description and present qualities reasonably expected by the buyer.

  • Article 1641 of the Civil Code: The Seller is bound by a warranty for hidden defects rendering the item unfit for its intended use.

Proof and Signature

  • The online entry of bank card details and final order validation constitute proof of acceptance of the contract under the law of March 13, 2000.

  • In the event of fraudulent use of a bank card, the Customer must immediately contact Parfumfrance.com customer service.

Product Use

Parfumfrance.com declines any responsibility for improper or incorrect use of its products.

Entire Agreement

If any clause of these Terms is declared invalid by a change in law or regulation, or by court decision, the remaining provisions shall remain fully enforceable.

SMS & Email Marketing

By providing their phone number or email address, the Customer agrees to receive recurring automated messages sent by Parfumfrance.com via Firepush (no more than 5 messages per week).

    Message and data rates may apply. An unsubscribe option is also provided in each message.

Duration

These Terms apply for the entire duration of services offered online by MHBW SAS.

Proof, Record-Keeping and Archiving

Electronic records stored under reasonable security conditions by MHBW SAS and its partners will be considered proof of communications, orders, and payments. Order forms and invoices are archived on reliable media in compliance with Article 1348 of the French Civil Code.

Governing Law and Jurisdiction

  • These Terms are subject to French law.

  • In case of dispute, and failing amicable settlement, disputes will be referred to the competent French courts, in accordance with the French Consumer Code (Article R.631-3) and the Code of Civil Procedure (Article 46).

  • As provided by EU Regulation No. 524/2013 of May 21, 2013, consumers may use the online dispute resolution platform provided by the European Commission.
